EWS Reservation: SC Says, It Will Proceed On Suggestions of Attorney General

NEW DELHI: While hearing pleas filed which enquired what was the constitutional validity of reserving 10 perecent seats to EWS class on the basis of economic conditions, Supreme Court on Thursday said that it will proceed with the three issues which were suggested by the Attorney General of India .
Remarkably, a Constitutional Bench headed by Chief Justice of India Lalit while giving judgement on EWS Reservation issue which is also related with the stakes of political parties had said that the judges bench will proceed with the first three issues which were suggested by the Attorney General of India as they encapsulates the entire case. Mediating in the case, the Attorney General of India KK Venugopal had asked – whether the 103rd Constitution Amendment can be said to breach the basic structure of the Constitution ..by permitting the states to make special provisions for EWS reservation and whether this amendment breaches the very basic ethos and structure of the constitution which also permits states to special provisions for ging reservation to this class on the economic criteria.
The other two issues which need to be given consideration are whether the 103rd Constitution Amendment can be said to breach the basic structure of the constitution while excluding SEBCs/OBCs/SCs/STs from the scope of reservation. Remarkably, hearing in the matter will begin from September 13.
The constitutional validity of the 103rd Amendment Act, 2019 .which enabled the states to make reservations in higher education and matters of public employment on the basis of eeconomic criteria will be the first matter to be heard.
to be examined by a five-judge bench, led by Chief Justice headed by Chief Justice of India UU Lalit.
