Supreme Court to Hear Plea of Shiv Sena’s Against Floor Test: Hearing Will Take Place Today at 5 PM

The Supreme Court has decided to hear the Shiv Sena’s petition filed by Shiv Sena Chief Whip Sunil Prabhu on an urgent basis against the Governor’s floor test order. The matter is listed before a vacation bench comprising Justice Surya Kant and JB Pardiwala. 

After hearing both the parties, the Supreme Court said “Keeping in view the mind of urgency that has been created, we will want to hear the matter today. We will perform our duty, says the court fixing the hearing today at 5 pm.”

Senior Advocate and Congress leader Abhishek Manu Singhvi presented the matter appearing for the Shiv Sena and made an argument that keeping in mind Supreme Courts’ earlier order in which it gave an interim order to protect the rebel MLAs from disqualification can get misused if the floor test ordered by Governor. 

Senior advocate Neeraj Kishan Kaul representing the side of Eknath Shine presented his argument by stating that disqualification proceedings have nothing to do with the floor test. And he requested a hearing tomorrow but the Supreme Court insisted on a hearing today evening.

Appearing for Maharashtra Governor, Solicitor General Tushar Mehta said “ He had no objection to the matter being heard today at 5 pm.”

The plea was presented against the order of Governor, Bhagat Singh Koshiyari by directing Maharashtra Chief Minister Uddhav Thackeray to face a floor test till 5 PM on June 30, also added that the proceeding will be complete on that same day. 

Recently, the Supreme Court of India has held that a Governor can call for a floor test at any time and if the Governor feels that the government in power has lost the confidence of the House.
