A Special Interview with RCBA President Inder Singh Saroha

In a straight talk with Inder Singh Saroha who is the President of the Rohini Court Bar Association, our Senior Correspondent Varun Jauhari, when asked why there is a pendency of cases in our courts, Saroha candidly said that we should make our best efforts that an innocent person does not suffer due to lackadaisical system. For an instance , we should ensure that an innocent person is not sentenced even if we let off other hundred people having criminal character.

Rohini Bar Association President who has imparted his invaluable service for bringing improvement to the justice system and improving the status of Bar Associations started his career in the legal profession as early as in January 1985 and has served in this noble profession for the last 35 years. He possesses past experience in dealing with Civil matters till 2005, however, after 2006, he started putting his hands in criminal matters also during his stint earlier in Tis Hazari Court and now in Rohini Court

While sharing his past experience on his suggestions as to how budding students of law will guide people in getting justice and become better lawyers, Saroha said that my suggestion is for them that they should first learn what is Criminal Procedure Code, Indian Penal Code, and  Indian Evidence Act. before finally becoming a practicing lawyer. He even suggested that they should focus on the definition clauses of these acts and start practicing developing clear ideas in their respective acts. 

Saroha is one of the names in the legal fraternity who started as a common lawyer and is now a Bar Association President, he also helped in making chambers of advocates in the Rohini Courts for the benefit of the advocates.  There were no proper sitting arrangements so he also proposed and helped in the development of the court by helping to construct the Bar rooms for meetings. 

During his 2014-2016 tenure he also helped to construct the gym and snooker facilities and helped build a room for advocates who did not have their chambers in the court. He also helped in making sufficient spaces for advocates. 

Saroha also suggested focusing on Major areas while dispensing justice. He also said that the major reason for the pendency of cases in our courts was our democratic working system. While giving an example of a case in which judgment is pending due to a witness not appearing in the court he said, if the witness doesn’t appear then the court maintains its right to order a summon, and hear the matters of various accused from different angles. He lamented over the thing that our procedure takes too much time and it requires carrying out such measures as cross-examination of witnesses, the re-examination of witnesses, calling of the witnesses as well as various other factors.

While expressing his views on the increasing demand that the court proceedings should be made digital so that it brings more impartiality in dispensing justice, Saroha said that a few things can be made digital, however, there are a few other things that cannot be made totally digital. If we want to follow Western countries, it cannot be possible in a country like India which rues over lack of a proper system.
