Orders from the review committee are to be published, not filed away: Justices’ ruling on the J&K internet ban

The Union Territory (UT) of Jammu and Kashmir was urged by the Supreme Court on Tuesday to make public the review committee’s rulings regarding internet prohibitions in the area.

Judges BR Gavai and Sanjay Karol’s bench noted, “Review (committee) orders are not intended to be stored in a wardrobe. You release! You must.

A variety of applications were being heard by the court as part of a petition against the nation’s regular internet outages. In compliance with the 2020 verdict in Anuradha Bhasin v. Union of India by the Supreme Court, the J&K administration’s review committee orders were asked to be published in the application.

The UT’s Additional Solicitor General (ASG), KM Nataraj, informed the court that he would ask for guidance on the situation. He countered that it is not necessary to make the discussions public.

Together with Advocate Natasha Maheshwari, Advocate Shadan Farasat emphasised the non-compliance of review orders with the Anuradha Bhasin ruling while representing the petitioner. The bench postponed the decision for two weeks, citing the prima facie argument that orders, not discussions, must be made public.
