Advocate Files PIL against New Criminal Laws in Supreme Court

Bharatiya Nyaya Sanhita, Bharatiya Nagarik Suraksha Sanhita, and Bharatiya Sakshya Adhiniyam are the three new criminal law amendment acts that are being challenged in a public interest litigation (PIL) that was filed before the Supreme Court.

The Indian Penal Code (IPC), the Code of Criminal Procedure (CrPC), and the Indian Evidence Act will be replaced, respectively, by the Bharatiya Nyaya Sanhita, the Bharatiya Nagarik Suraksha Sanhita, and the Bharatiya Sakshya Adhiniyam.

The three pieces of legislation, which were approved by the parliament during its winter session of the previous year, aim to reform India’s criminal justice system. The President of India gave his assent to them on December 25. Although the announcement was made on the Rashtrapati Bhavan website, the rules have not yet been framed, hence the development has not yet been published in the Indian Gazette.

As a result, the three laws have not yet been implemented. Vishal Tiwari’s appeal emphasised that the laws are flawed, inconsistent, and disregard the recommendations of the Law Commission. “All three criminal laws were passed and enacted without any parliamentary debate, as unfortunately most of the members were under suspension during the period. The title of these proposed bills does not speak about the statute or its motive, but the present names of the acts are ambiguous in nature,” the petitioner wrote.
