Delhi High Court Directs Former Rajya Sabha MP Subramanian Swamy To Hand Over Govt. Accommodation Within Six Weeks

Coming as a setback to the former BJP Rajya Sabha MP Subramanian Swamy who is still staying at AB-14, Pandara Road, New Delhi has been asked to hand over the possession of his government accommodation within six weeks. However, due to a threat to life, he will be availing of Z class security. Delhi High Court ruled that the bungalow allotted to him in 2016 must be turned over to the estate officer soon.
Remarkably, Swamy who is known for his verbatims was allotted the government accommodation in the Lutyens zone by the cabinet committee in January 2016 for a period of five years as term as a Rajya Sabha MP came to an end on April 2022. However, he didn’t vacate his government accomodation citing security concerns on which. Therefore, he was served with a notice , afterwards, he knocked the doors of the high court while seeking re-allotment of the accommodation saying that he faced veritable security threats.
However, the Centre opposed the plea arguing that even though the security perception towards Swamy hasn’t been downgraded, there is no obligation on the government side to provide an accommodation to him along with security cover for more time.
Delhi High Court Justice Yashwant Varma while giving his judgment on Swamy’s plea observed that there was no material to show that the applicant required the allotment of the government bungalow as per his claims. The Court further directed him to ensure that the possession in question is handed over to the estate officer concerned within a period of six weeks from today,” the court said while disposing of his plea.
The senior BJP leader had argued that the government accommodation should be continued keeping the required security arrangements in mind. ASG Sanjay Jain said that Swamy could move into his own residence in Nizamuddin East after vacating his current residence. Advocate Jayant Mehta who appeared for the former MP said that this could be done ‘only if Home Ministry ensures that they will do everything desired to help with shifting, safety and security.
