Consumer Court:Facing Fraud or Poor Service? Here’s How to File a Consumer Court Complaint

Here’s a detailed step-by-step guide on how any Indian citizen can file a complaint in the Consumer Court without fear or legal complexity.


Who Can File a Complaint?

According to Section 2(7) of the Consumer Protection Act, a complaint can be filed by:

  • Any individual who purchased goods or hired services
  • A registered consumer association
  • Central or State Government
  • Legal heirs or representatives of a deceased consumer

The term “consumer” includes both offline and online buyers, thus empowering even those who face fraud through e-commerce platforms.


What Complaints Can Be Filed?

A complaint can be registered for:

  • Defective goods (e.g., broken electronics, expired products)
  • Deficient services (e.g., poor medical treatment, late delivery)
  • Unfair trade practices (e.g., misleading ads)
  • Overcharging or unauthorized billing
  • Sale of hazardous or unsafe products

Before approaching the court, it’s advisable to send a legal notice to the company or individual, giving them 15 to 30 days to resolve the issue. This step often leads to a quick settlement.


Step 2: Drafting the Complaint

A consumer complaint should clearly mention:

  • The name, address, and contact details of the complainant
  • The name and address of the opposite party
  • Date and details of the transaction
  • Supporting documents (bills, warranty, photos, email correspondence)
  • The relief claimed (refund, replacement, compensation)

Attach a notarised affidavit verifying the truth of your complaint.


Step 3: Know Where to File

The Consumer Commissions are categorized by the value of the claim:

The Ministry of Consumer Affairs launched the E-Daakhil portal for online complaints. This digital platform:

  • Allows users to register complaints
  • Upload documents
  • Track the case status online

No physical presence is required for filing, making access to justice easier across India.


Step 5: Pay the Nominal Fee

The fee is minimal, making Consumer Courts highly accessible:

  • The court may order refund, replacement, or compensation

Lawyers are not mandatory in Consumer Courts. You can present your case yourself if it’s simple.


Limitation Period

Complaints must be filed within two years from the date of cause of action. However, the court may condone the delay if sufficient reason is shown.

Consumer forums across India have delivered justice in landmark cases. In 2023, a Gurgaon resident was awarded ₹2 lakh compensation for receiving a fake smartphone from an e-commerce website. In another case, a private hospital was penalized ₹10 lakh for wrong diagnosis.
