Supreme Court to Hear Petitions by Journalist Rana Ayyub, Borrowers Against Lending Banks, and More on January 25

Petition by journalist Rana Ayyub challenging the summons issued by the Ghaziabad court

The Supreme Court will hear on January 25 a petition by journalist Rana Ayyub challenging the summons issued by the Ghaziabad court.

In fact, the Ghaziabad court has issued a summons against Ayyub after taking cognizance of the charge sheet filed by the Enforcement Directorate.

Journalists have reached the Supreme Court against this. It is alleged that Rana Ayyub has illegally collected funds from the general public in the name of charity by running a campaign through an online crowd-funding platform, ‘Keto’.

As per the ED investigation, the funds raised on the online platform were transferred to the accounts of Ayub’s father and sister.

Case of borrowers against lending banks or financial institutions

The Supreme Court will hear on January 25 the case of borrowers against lending banks or financial institutions.

This petition has been filed on behalf of CPIL. In the last hearing, the court had said that even if the bank or financial institution is taking separate recovery action before the Debt Recovery Tribunal (DRT) under a special law, it can be done.

The Court is considering a complex question of law whether a borrower who is facing debt recovery proceedings by banks and financial institutions before the DRT can file a counter-suit in a civil court against the financial institutions.

Petition filed by Devvrat Haldar on January 25

The Supreme Court will hear the petition filed by Devvrat Haldar on January 25.

ED has filed a Prosecution Complaint (Chargesheet) against Devvrat Haldar, officials of National Small Industries Corporation (NSIC), and others for causing a loss of Rs 173.50 crore to NSIC and banks.

Devvrat Haldar was arrested in 2021 and was sent to ED custody for 14 days. At present, he is in judicial custody.

The petitioners’ counsel Mohd Yusuf and others have termed the trial court’s December 19 order extending the time limit to conduct the probe by 60 days as wrong.

He said the agency was given extra time without giving him any notice of the prosecutor’s report.
